01Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the Atex Hub website, its tools, and its interface for crypto swaps and purchases (together, the "Service"). The Service is operated by Atex Hub ("Atex Hub", "we", "us", or "the operator").

By using the Service you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Risk Disclosure. If you do not agree, do not use the Service.

02Definitions

In these Terms:

• "Swap" means an exchange of one crypto asset for another that you request through the Service.
• "Partner" means a third-party exchange, liquidity, or payment provider that executes your swap or purchase.
• "Quote" means the estimated or fixed amount you are shown before you confirm a swap.
• "Deposit address" means the address generated for your swap, to which you send the asset you want to exchange.
• "Exchange ID" means the reference number assigned to your swap, used to track it and to request support.

03Eligibility

You must be at least 18 years old and have the legal capacity to accept these Terms. You must not be located in, or a resident or national of, a country or region subject to comprehensive sanctions, and you must not be listed on any sanctions list.

You may not use the Service where using it is prohibited by the law that applies to you. You must not use a VPN, proxy, or other method to hide your location in order to get around these restrictions. You are responsible for making sure your use of the Service is legal where you are.

04Nature of the Service

Atex Hub is a non-custodial interface. We do not hold, control, or have access to your funds or private keys at any time, and we are not a party to your swap or purchase.

When you request a swap, your request is passed to a Partner, which provides the quote, generates the deposit address, receives your deposit, and sends the exchanged asset to the address you provide. Card and bank purchases or sales are handled entirely inside the payment Partner's own flow.

Atex Hub is not a bank, broker, exchange, money transmitter, or custodian, and does not offer accounts, wallets, or stored balances.

05Third-party Partners

Swaps and purchases are executed by independent third-party exchange and payment Partners. Their own terms of use, privacy policies, and compliance rules apply to your transaction in addition to these Terms, and you are responsible for reviewing them.

We do not control Partners and are not responsible for their availability, pricing, compliance decisions, delays, errors, or failures. Partners may change, and we may add or remove Partners at any time without notice.

06Quotes and rates

Quotes are provided by Partners and depend on market conditions, liquidity, and network fees. A quote shown before you confirm is an estimate unless it is clearly marked as fixed.

With a floating (standard) rate, the amount you receive is calculated when your deposit is confirmed and may be higher or lower than the estimate. With a fixed rate, the rate is held only for a limited time; if your deposit arrives after that window, or for a different amount, the Partner may recalculate the rate or refund your deposit.

Minimum and maximum amounts apply to each pair and are shown before you confirm.

07Fees

The amount shown in a quote already reflects the Partner's exchange spread and any service fee. Blockchain network fees are also deducted or included as shown in the quote. Atex Hub does not charge you any separate fee on top of the quote.

Your own wallet or exchange may charge a separate fee to send your deposit. Those fees are outside our control.

08Compliance checks

Partners operate their own anti-money-laundering (AML), know-your-customer (KYC), and sanctions screening. A Partner may pause a transaction and ask you for identity or source-of-funds information before it completes.

If a check cannot be completed, a Partner may refuse the transaction, hold the funds as required by law, or return them to your refund address, less network fees. Atex Hub cannot override a Partner's compliance decision.

09Failed, late, and incorrect deposits

You must send exactly the asset, on exactly the network, shown in the deposit instructions, and include any required memo, tag, or extra ID. Deposits sent on the wrong network, in the wrong asset, without a required memo, or to an expired deposit address may be lost or may only be recoverable by the Partner manually, at its discretion and possibly for a fee.

Where a refund is possible, it is sent to the refund address you provided or, if none, to an address you confirm with the Partner. Keep your exchange ID: it is the only way to identify your swap.

10Your responsibilities

You are responsible for:

• Providing correct destination and refund addresses, networks, and any memo or tag.
• Keeping your wallet, private keys, and seed phrase secure. We will never ask for them.
• Checking quotes, amounts, and deposit instructions before sending funds.
• Making sure the funds you use are lawfully yours.
• Reporting and paying any taxes that apply to your transactions.

11Prohibited use

You must not use the Service to:

• Launder money, finance terrorism, or evade sanctions.
• Handle proceeds of fraud, theft, ransomware, scams, or any other crime.
• Interfere with, overload, scrape at scale, or attempt to gain unauthorized access to the Service or its systems.
• Get around eligibility, location, or rate limits, including by automated means.
• Impersonate Atex Hub or any other person, or mislead others about your connection to us.
• Break any law or regulation that applies to you.

12Intellectual property

The Service, including its design, text, graphics, logos, and code, belongs to Atex Hub or its licensors. You may use the Service for your own personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from it without our written permission. Third-party names and logos, including coin logos, belong to their owners.

13No advice

Prices, charts, articles, and other information on the Service are provided for general information only. Nothing on the Service is investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any asset. Market data comes from third-party sources and may be delayed or inaccurate.

14Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including that the Service will be uninterrupted, error-free, secure, or that any quote, rate, or information will be accurate or available.

15Limitation of liability

To the fullest extent permitted by law, Atex Hub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, funds, data, or opportunity, arising from your use of the Service. This includes losses caused by user error, incorrect addresses or networks, market movements, blockchain or network failures, or the acts or omissions of Partners.

Nothing in these Terms limits liability that cannot be limited under the law that applies to you, such as liability for fraud or for death or personal injury caused by negligence.

16Indemnification

You agree to indemnify and hold harmless Atex Hub and anyone working on its behalf from any claims, losses, and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

17Suspension and termination

We may restrict, suspend, or end your access to the Service at any time, with or without notice, if we reasonably believe you have broken these Terms, if required by law or a Partner, or to protect the Service or other users. Sections that by their nature should survive termination will survive.

18Governing law

These Terms are governed by applicable law. Nothing in these Terms affects any mandatory consumer protection rights you have under the law of the country where you live.

19Changes to these Terms

We may update these Terms from time to time. The "Last updated" date shows when they last changed. For material changes we will give at least 30 days' notice on the Service before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.

20General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy and Risk Disclosure, are the entire agreement between you and Atex Hub about the Service.
